Israel and the future of Gaza – what are the legal issues? 

During this webinar, we discussed the complex legal issues arising from the recent 20-point Peace Plan for Gaza, and the International Court of Justice’s Advisory Opinion on Israel’s legal obligations in Gaza (22 October).

President Trump’s Peace Plan envisages the release of all hostages (dead and alive), demilitarisation and removal of Hamas, the creation of an internationally-sponsored interim government, and reconstruction of Gaza.

  • It is already starting to fall apart, as Hamas is entrenching its position in Gaza?
  • What steps can Israel take? Is Israel entitled to launch a new military offensive against Gaza?
  • How is a new government to be formed?

These matters are complicated by the ICJ’s recent Advisory Opinions, which state that Israel is obliged to vacate Gaza, to ensure the Palestinians are enabled to have their own state, and to collaborate with UN organisations, especially UNRWA.
